COUNCIL PROCEEDINGS

CITY OF GRANT, NEBRASKA

November 14, 2023

 

                Mayor Lisa Schmitt convened a meeting of the Council of the City of Grant, Nebraska in open and public session on November 14, 2023 at 7:00 p.m.  Notice of this meeting was given in advance by publication in the Grant Tribune Sentinel, the City’s designated method for giving notice, November 2, 2023, and members of the City Council and a copy of their Acknowledgment of Receipt and the Agenda are attached to these minutes.  Availability of the Agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting. All proceedings hereafter shown were recorded while said meeting was open to the attendance of the public.

Mayor Lisa Schmitt announced the posting of the Open Meetings Act and its location.

Roll call:  Present Council members:  Bishop, Brueggeman, Sims and Mayor Schmitt. Absent: Council member: Petersen.

Others present:  City Superintendent Edward Dunn, City Clerk/Treasurer Jessie Faber, City Attorney Tawna Holmstedt, et al.

The motion was made by Brueggeman and seconded by Sims to accept the agenda as presented.

Roll call vote:  Yeas – all present. Nays – none.  Motion carried.

A motion was made by Brueggeman to approve the minutes of the October 24, 2023 meeting as presented and waive the reading and seconded by Sims.

Roll call vote:  Yeas – Brueggeman & Sims. Nays – none. Abstain – Bishop.  Yea – Mayor Schmitt.  Motion carried.

 

COMMUNICATIONS:  City Superintendent, Edward Dunn gave updates on the downtown revitalization project, chlorination of the water system, and the office assistant position.

 

STANDING COMMITTEE REPORTS: 

Council member, Petersen – none. Council member, Bishop – none. Council member, Brueggeman –none. Council member, Sims – none. City Superintendent, Dunn – gave an update on the cemetery board meeting.

 

ENFORCEMENT, SHERIFF & WATER REPORTS – Acknowledged as received.

 

FINANCIALS – The financials are in process and will be reviewed at the next meeting.

UNFINISHED BUSINESS:

Action and Discussion on Ordinance 23-10-01, an Ordinance of the Mayor and Council of the City of Grant, Perkins County, Nebraska, Amending Section 5-201 – Registration; Issuance of Permit of Article 2 – Peddlers and Solicitors of Chapter 5 – Business Regulations of the City of Grant Revised Municipal Code – Adding Language Concerning Food Trucks; and Providing When This Ordinance is in Full Force an Effect. (Second Reading) – City Clerk, Jessie Faber read the second reading of Ordinance No. 23-10-01 “An Ordinance of the Mayor and Council of the City of Grant, Perkins County, Nebraska, Amending Section 5-201 – Registration; Issuance of Permit of Article 2 – Peddlers and Solicitors of Chapter 5 – Business Regulations of the City of Grant Revised Municipal Code – Adding Language Concerning Food Trucks; and Providing When This Ordinance is in Full Force an Effect.”

 

Action and Discussion on Ordinance 23-10-02, an Ordinance of the City of Grant, Perkins County, Nebraska, Authorizing the Perkins County Treasurer to Collect Special Assessment; to Repeal all Other Ordinances and Resolutions, or Parts Thereof in Conflict; to Provide That the Provisions of This Ordinance Shall be Made a Part of the Code of the City of Grant; and to Provide When this Ordinance Shall Be in Full Force and Effect. (149 Washington Avenue, Grant, Nebraska – Lots 15 & 16, Block 38, Original Town of Grant, Perkins County, Nebraska) (Second Reading) – No Action Taken.

 

Action and Discussion on Ordinance 23-10-03, an Ordinance of the City of Grant, Perkins County, Nebraska, Authorizing the Perkins County Treasurer to Collect Special Assessment; to Repeal all Other Ordinances and Resolutions, or Parts Thereof in Conflict; to Provide That the Provisions of This Ordinance Shall be Made a Part of the Code of the City of Grant; and to Provide When this Ordinance Shall Be in Full Force and Effect. (428 East Hwy 23, Grant, Nebraska – A Part of South 1/2 of the NW 1/4, of Section 13, Township 10 North, Range 39, West of the 6th P.M., Perkins County, Nebraska) (Second Reading) – No Action Taken.

Action and Discussion on Resolution 23-11-01, a Resolution of the Mayor and Council of the City of Grant, Perkins County, Nebraska, Rescinding Prior Resolution No. 23-06-08, Declaration of Nuisance Properties (838 Garfield Ave.) – A motion was made by Brueggeman to approve Resolution No. 23-11-01, a Resolution of the Mayor and Council of the City of Grant, Perkins County, Nebraska, Rescinding Prior Resolution No. 23-06-08, Declaration of Nuisance Properties (838 Garfield Ave.) and seconded by Bishop.

Roll call vote:  Yeas – all present. Nays – none.  Motion carried.

The Resolution will be published in pamphlet form.

 

Action and Discussion on Mayor’s Request for Discussion on Potential Discontinuation of the Noon and 5 P.M. Whistle – Discussion took place on the potential discontinuation of the Noon and 5 P.M. Whistle.  No Action Taken.

 

A motion was made by Bishop to go into executive session due to potential litigation and to include the Council Members, Mayor, City Attorney, City Clerk, and City Superintendent and seconded by Sims.

Roll call vote:  Yeas – all present. Nays – none.  Motion carried.

Entered Executive Session at 7:29 pm.

Exited Executive Session at 8:37 pm.

The motion was made by Bishop and seconded by Sims to approve the Bills and Claims in the amount of $313,898.44.

Bishop, Brueggeman, & Sims reviewed the bills and claims prior to the meeting.

 

Mayor Lisa Schmitt adjourned this meeting of the Grant City Council at 8:38 P.M.
