COUNCIL PROCEEDINGS

CITY OF GRANT, NEBRASKA

October 24, 2023

 

                Mayor Lisa Schmitt convened a meeting of the Council of the City of Grant, Nebraska in open and public session on October 24, 2023 at 7:00 p.m.  Notice of this meeting was given in advance by publication in the Grant Tribune Sentinel, the City’s designated method for giving notice, October 19, 2023, and members of the City Council and a copy of their Acknowledgment of Receipt and the Agenda are attached to these minutes.  Availability of the Agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting. All proceedings hereafter shown were recorded while said meeting was open to the attendance of the public.

Mayor Lisa Schmitt announced the posting of the Open Meetings Act and its location.

Roll call:  Present Council members:  Brueggeman, Petersen, Sims and Mayor Schmitt. Absent: Council member: Bishop.

Others present:  City Superintendent Edward Dunn, City Clerk/Treasurer Jessie Faber, City Attorney Tawna Holmstedt, et al.

The motion was made by Brueggeman and seconded by Petersen to accept the agenda as presented.

Roll call vote:  Yeas – all present. Nays – none.  Motion carried.

A motion was made by Brueggeman to approve the minutes of the October 10, 2023 meeting as presented and waive the reading and seconded by Petersen.

Roll call vote:  Yeas – Brueggeman & Petersen. Nays – none. Abstain – Sims.  Yea – Mayor Schmitt.  Motion carried.

 

COMMUNICATIONS:  City Superintendent, Edward Dunn informed the Council of the upcoming board meeting, the Community Redevelopment Authority (CRA) will meet October 30th at noon. Dunn gave updates on the storm drain repairs and paving on 3rd street, the pool painters were here to restripe the pool and fix a few spots, a pool slide company did an assessment of the slide & are preparing a quote for an annual maintenance agreement,  the public works employees have begun winterizing the sprinklers, the grants Southwest Nebraska Community Betterment Corporation has recently received,  the survey for the housing development projects, the IT updates are still being completed at the office, the audit  fieldwork portion was completed & the downtown revitalization project.

 

STANDING COMMITTEE REPORTS: 

Council member, Petersen – none. Council member, Bishop – none. Council member, Brueggeman –none. Council member, Sims – none. City Superintendent, Dunn – gave an update on the library board meeting.

 

SHERIFF REPORT – No Action Taken.

 

FINANCIALS – Were acknowledged as received at the October 10, 2023 meeting.  No Additional Action Taken.

Action and Discussion on Service Schedule M (SMM) Agreement Modernization Between the City of Grant and the Municipal Energy Agency of Nebraska (M.E.A.N.) – Carol Brehm (Nebraska Municipal Power Pool Member Relations Representative) – Carol Brehm, Nebraska Municipal Power Pool Member Relations Representative gave a presentation of the Service Schedule M (SMM) Agreement Modernization between the City of Grant and the Municipal Energy Agency of Nebraska and answered any questions the Council had on the presentation.  No Action Taken.

 

Action and Discussion on Approval of Proposal for the City of Grant SCADA (Water Tower, Wells and Sewer Management Software and Hardware) System Updates Between the City of Grant and Atlas Automation, Inc. – A motion was made by Brueggeman to approve the proposal for the City of Grant SCADA (water tower, wells and sewer management software and hardware) System Updates Between the City of Grant and Atlas Automation, Inc. in the amount of $59,962.25 plus applicable taxes and authorize the Mayor to sign and seconded by Petersen.

Roll call vote:  Yeas – all present. Nays – none.  Motion carried.

 

Action and Discussion on Resolution 23-10-01, a Resolution of the Mayor and Council of the City of Grant, Perkins County, Nebraska, Rescinding Prior Resolution No. 23-07-10, Declaration of Nuisance Properties (949 Sherman Ave.) – A motion was made by Petersen to approve Resolution No. 23-10-01, a Resolution of the Mayor and Council of the City of Grant, Perkins County, Nebraska, Rescinding Prior Resolution No. 23-07-10, Declaration of Nuisance Properties (949 Sherman Ave.) and seconded by Sims.

Roll call vote:  Yeas – all present. Nays – none.  Motion carried.

The Resolution will be published in pamphlet form.

 

Action and Discussion on Ordinance 23-10-01, an Ordinance of the Mayor and Council of the City of Grant, Perkins County, Nebraska, Amending Section 5-201 – Registration; Issuance of Permit of Article 2 – Peddlers and Solicitors of Chapter 5 – Business Regulations of the City of Grant Revised Municipal Code – Adding Language Concerning Food Trucks; and Providing When This Ordinance is in Full Force an Effect. – City Clerk, Jessie Faber read the first reading of Ordinance No. 23-10-01 “An Ordinance of the Mayor and Council of the City of Grant, Perkins County, Nebraska, Amending Section 5-201 – Registration; Issuance of Permit of Article 2 – Peddlers and Solicitors of Chapter 5 – Business Regulations of the City of Grant Revised Municipal Code – Adding Language Concerning Food Trucks; and Providing When This Ordinance is in Full Force an Effect.”

 

Action and Discussion on Ordinance 23-10-02, an Ordinance of the City of Grant, Perkins County, Nebraska, Authorizing the Perkins County Treasurer to Collect Special Assessment; to Repeal all Other Ordinances and Resolutions, or Parts Thereof in Conflict; to Provide That the Provisions of This Ordinance Shall be Made a Part of the Code of the City of Grant; and to Provide When this Ordinance Shall Be in Full Force and Effect. (149 Washington Avenue, Grant, Nebraska – Lots 15 & 16, Block 38, Original Town of Grant, Perkins County, Nebraska) – City Clerk, Jessie Faber read the first reading of Ordinance No. 23-10-02 “An Ordinance of the City of Grant, Perkins County, Nebraska, Authorizing the Perkins County Treasurer to Collect Special Assessment; to Repeal all Other Ordinances and Resolutions, or Parts Thereof in Conflict; to Provide That the Provisions of This Ordinance Shall be Made a Part of the Code of the City of Grant; and to Provide When this Ordinance Shall Be in Full Force and Effect.”

 

A motion was made by Sims to go into executive session due to potential litigation and to include the Council Members, Mayor, City Attorney, City Clerk, and City Superintendent and seconded by Petersen.

Roll call vote:  Yeas – all present. Nays – none.  Motion carried.

Entered Executive Session at 8:15 pm.

Exited Executive Session at 8:24 pm.

A motion was made by Sims to come out of executive session and seconded by Petersen.

Action and Discussion on Ordinance 23-10-03, an Ordinance of the City of Grant, Perkins County, Nebraska, Authorizing the Perkins County Treasurer to Collect Special Assessment; to Repeal all Other Ordinances and Resolutions, or Parts Thereof in Conflict; to Provide That the Provisions of This Ordinance Shall be Made a Part of the Code of the City of Grant; and to Provide When this Ordinance Shall Be in Full Force and Effect. The motion was made by Brueggeman and seconded by Sims to approve the Bills and Claims in the amount of $157,829.50.

Roll call vote:  Yeas – all present. Nays – none.  Motion carried.

 

Brueggeman, Petersen & Sims reviewed the bills and claims prior to the meeting.

 

Mayor Lisa Schmitt adjourned this meeting of the Grant City Council at 8:26 P.M.
