COUNCIL PROCEEDINGS
CITY OF GRANT, NEBRASKA
March 23, 2010

            Mayor Michael Wyatt convened a meeting of the Council of the City of Grant, Nebraska in open and public session on March 23, 2010 at 7:00 p.m.  Notice of this meeting was given in advance by publication in the Grant Tribune Sentinel, the City’s designated method for giving notice, March 18, 2010, and members of the City Council and a copy of their Acknowledgment of Receipt and the Agenda are attached to these minutes.  Availability of the Agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting.  All proceedings hereafter shown were recorded while said meeting was open to the attendance of the public.
Mayor Wyatt announced the posting of the Open Meetings Act and its location.
Roll call:  Present Council members: Hansen, Pick, Pierce, Pofahl and Mayor Wyatt.
Others present:  City Administrator Tyson McGreer, City Clerk/Treasurer Jessie Faber, City Attorney Phil Pierce, et al.
The motion was made by Pierce and seconded by Pofahl to approve the agenda as presented.  Roll call vote:  Yeas – all present. Nays – none.  Motion carried.
A motion was made by Hansen to approve the minutes of the March 9, 2010 meeting and waive the reading seconded by Pierce.
Roll call vote:  Yeas – all present. Nays – none.  Motion carried.
A motion was made by Pofahl to approve the minutes of the March 20, 2010 meeting and waive the reading seconded by Hansen.
Roll call vote:  Yeas – all present. Nays – none.  Motion carried.

COMMUNICATIONS:  City Manager, Tyson McGreer, informed the council that the planning and zoning committee will be planning a hearing the first part of April on the zoning ordinance.  Tyson had attended the County Planning and Zoning Meeting Monday night and reported on the meeting.  Tyson said that on the water main project it is being considered instead of using asphalt between 1st and 2nd street on Lincoln replacing that portion with concrete because of the heavy traffic on that block.  The office has received a few calls in reference to the council retreat and Tyson has explained the retreat was only a brainstorming session to setup some possible goals for the city and that no action was taken on specific items.

STANDING COMMITTEE REPORTS: 
Council member, Hansen – none.  Council member, Pofahl – none.  Council member, Pick – gave an update on the airport. Council member, Pierce – gave an update on the tree board.

UNFINISHED BUSINESS:
Action on Resolution 10-03-02 Cemetery Regulations – A motion was made by Pierce to approve Resolution 10-03-02 and seconded by Pick.
RESOLUTION NO. 10-03-02
RESOLUTION APPROVING CEMETERY RULES & REGULATIONS
FOR THE CITY OF GRANT, NEBRASKA

            The Mayor and Council of the City of Grant (hereinafter the City), in regular session assembled at the City Office Building in Grant, Nebraska on this 23rd day of March, 2010, hereby resolve as follows:

WHEREAS, the City of Grant owns and maintains the Fairview Cemetery as part of the City; and

            WHEREAS, he Mayor and City Council has the authority as allowed by Nebraska Revised Statutes §12-401 to 12-403 and the City of Grant, Code of Ordinance No. 09-08-02 Chapter 91 to “…pass such rules and regulations for the operation of the cemetery…”; and

            WHEREAS, updated rules and regulation have been prepared; and

            NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of the City of Grant that the Grant Cemetery Rules and Regulations, as attached hereto, are adopted and shall be in full force and effect until same is reversed, terminated or modified by further resolution.

            BE IT FURTHER RESOLVED that this Resolution shall take effect and be in full force from and after its passage, approval and publication as required by law.

            PASSED, APPROVED AND ADOPTED THIS 23rd DAY OF MARCH, 2010

Roll call vote:  Yeas – Hansen, Pick & Pofahl. Nays – Pierce.  Motion carried
The Attached Grant Cemetery Rules and Regulations to this resolution will be published by pamphlet form.

Action on Airport Advisory Committee Recommendation – The council discussed the airport advisory committee recommendation and Bob Bounds and Leon Kumor answered council questions. No Action Taken.

Total Bills and Claims $101,523.08.

The motion was made by Pierce and seconded by Hansen to approve the Bills and Claims in the amount of $101,523.08.
Roll call vote:  Yeas – all present.  Nays – none.  Motion carried.

Hansen, Pick, Pierce, & Pofahl reviewed the bills and claims prior to the meeting.

Mayor Wyatt adjourned this meeting of the Grant City Council at 7:52 P.M.
