COUNCIL PROCEEDINGS
CITY OF GRANT, NEBRASKA
December 8, 2009

            Mayor Michael Wyatt convened a meeting of the Council of the City of Grant, Nebraska in open and public session on December 8, 2009 at 7:01 p.m.  Notice of this meeting was given in advance by publication in the Grant Tribune Sentinel, the City’s designated method for giving notice, December 3, 2009, and members of the City Council and a copy of their Acknowledgment of Receipt and the Agenda are attached to these minutes.  Availability of the Agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting.  All proceedings hereafter shown were recorded while said meeting was open to the attendance of the public.
Mayor Wyatt announced the posting of the Open Meetings Act and its location.
Roll call:  Present Council members:  Hansen, Pick, Pierce Pofahl, and Mayor Wyatt. 
Others present:  City Administrator Tyson McGreer, City Clerk/Treasurer Jessie Faber, et al.
The motion was made by Pierce and seconded by Pofahl to approve the agenda as presented.
Roll call vote:  Yeas – all present. Nays – none.  Motion carried.
A motion was made by Hansen to approve the minutes of the November 24, 2009 meeting and waive the reading and seconded by Pierce.
Roll call vote:  Yeas – all present. Nays – none.  Motion carried.

COMMUNICATIONS:  City Manager, Tyson McGreer, informed the council of an upcoming Planning & Zoning Hearing on January 5th, the Library Board postponed their meeting till December 15th due to the weather and the Cemetery Board cancelled their meeting today due to weather.  Tyson gave the council an updated on the water project which has not been active this week due to the weather.  The chamber is preparing for NTV The Road Less Traveled segment and wanted to know if the City wanted to present a key to the city or do something else.

STANDING COMMITTEE REPORTS: 
Council member, Hansen – the library will meet on the 15th. Council member, Pofahl – gave an update on the planning and zoning committee.  Council member, Pick – gave an update on the airport and the cemetery meeting was cancelled.  Council member, Pierce – none. 

WATER, ENFORCEMENT AND LOTTERY REPORTS - Acknowledged as received.

FINANCIALS – Acknowledged as received.

UNFINISHED BUSINESS:
Action on extending maintenance contract with Uehling’s Total Turf – A motion was made by Hansen to accept the renewal on the maintenance contract with Uehling’s Total Turf and seconded by Pick.

Action on Ordinance 09-11-01 Annexation – City Clerk, Jessie Faber read the second reading of Ordinance 09-11-01 “AN ORDINANCE ANNEXING IN THE WEST BOUNDARIES OF THE CORPORATE LIMITS FOR THE CITY OF GRANT; PROVIDING FOR THE FILING AT THE REGISTER OF DEEDS OFFICE FOR PERKINS COUNTY, NEBRASKA, REPEALING ALL RESOLUTIONS OR ORDINANCES IN CONFLICT; AND STATING THE DATE THE ORDINANCE BECOMES EFFECTIVE.”

Action on Ordinance 09-11-02 Annexation – City Clerk, Jessie Faber read the second reading of Ordinance 09-11-01 “AN ORDINANCE ANNEXING IN THE NORTH BOUNDARIES OF THE CORPORATE LIMITS FOR THE CITY OF GRANT; PROVIDING FOR THE FILING AT THE REGISTER OF DEEDS OFFICE FOR PERKINS COUNTY, NEBRASKA, REPEALING ALL RESOLUTIONS OR ORDINANCES IN CONFLICT; AND STATING THE DATE THE ORDINANCE BECOMES EFFECTIVE.”

Action on Ordinance 09-11-03 Annexation – City Clerk, Jessie Faber read the second reading of Ordinance 09-11-01 “AN ORDINANCE ANNEXING IN THE SOUTHWEST BOUNDARIES OF THE CORPORATE LIMITS FOR THE CITY OF GRANT; PROVIDING FOR THE FILING AT THE REGISTER OF DEEDS OFFICE FOR PERKINS COUNTY, NEBRASKA, REPEALING ALL RESOLUTIONS OR ORDINANCES IN CONFLICT; AND STATING THE DATE THE ORDINANCE BECOMES EFFECTIVE.”

Action on Ordinance 09-11-04 Annexation – City Clerk, Jessie Faber read the second reading of Ordinance 09-11-01 “AN ORDINANCE ANNEXING IN THE SOUTHEAST BOUNDARIES OF THE CORPORATE LIMITS FOR THE CITY OF GRANT; PROVIDING FOR THE FILING AT THE REGISTER OF DEEDS OFFICE FOR PERKINS COUNTY, NEBRASKA, REPEALING ALL RESOLUTIONS OR ORDINANCES IN CONFLICT; AND STATING THE DATE THE ORDINANCE BECOMES EFFECTIVE.”

Following the second readings discussion and questions were answered that the public had on Ordinance 09-11-01, 09-11-02, 09-11-03, & 09-11-04.

NEW BUSINESS:
Action on Ordinance 09-12-01 Enforcement Authority – City Clerk, Jessie Faber read the first reading of Ordinance 09-12-01 “AN ORDINANCE OF THE CITY OF GRANT, PERKINS COUNTY, NEBRASKA, AMENDING THE GRANT CITY CODE (ORDINANCE 02-03) BY REVOKING AND REPLACING §93.02 TITLED “ENFORCEMENT AUTHORITY” TO CLARIFY THE SECTION; TO REPEAL ALL OTHER ORDINANCES AND RESOLUTIONS, OR PARTS THEREOF IN CONFLICT; TO PROVIDE THAT THE PROVISIONS OF THIS ORDINANCE SHALL BE MADE A PART OF THE CODE OF THE CITY OF GRANT; AND TO PROVIDE WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT.”

Action on Ordinance 09-12-02 Amending 95.01 and 95.02 Running at Large – City Clerk, Jessie Faber read the first reading of Ordinance 09-12-02 “AN ORDINANCE OF THE CITY OF GRANT, PERKINS COUNTY, NEBRASKA, AMENDING THE GRANT CITY CODE (ORDINANCE 02-03) BY REVOKING AND REPLACING §95.01 TITLED “RUNNING AT LARGE” AND §95.02 TITLED “PROHIBITED ANIMALS AND FOWL TO CLARIFY AND SIMPLIFY THE SECTIONS; TO REPEAL ALL OTHER ORDINANCES AND RESOLUTIONS, OR PARTS THEREOF IN CONFLICT; TO PROVIDE THAT THE PROVISIONS OF THIS ORDINANCE SHALL BE MADE A PART OF THE CODE OF THE CITY OF GRANT; AND TO PROVIDE WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT.”

Action on Ordinance 09-12-03 Amending 51.81 Obtaining a Permit – City Clerk, Jessie Faber read the first reading of Ordinance 09-12-03 “AN ORDINANCE OF THE CITY OF GRANT, PERKINS COUNTY, NEBRASKA, AMENDING THE GRANT CITY CODE (ORDINANCE 02-03) BY REVOKING AND REPLACING §51.81 TITLED “PROCEDURE TO OBTAIN PERMIT” TO CORRECT THE SECTION; TO REPEAL ALL OTHER ORDINANCES AND RESOLUTIONS, OR PARTS THEREOF IN CONFLICT; TO PROVIDE THAT THE PROVISIONS OF THIS ORDINANCE SHALL BE MADE A PART OF THE CODE OF THE CITY OF GRANT; AND TO PROVIDE WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT.”

Action on Ordinance 09-12-04 Amending 133.01 Discharge of Firearms – City Clerk, Jessie Faber read the first reading of Ordinance 09-12-04 “AN ORDINANCE OF THE CITY OF GRANT, PERKINS COUNTY, NEBRASKA, AMENDING THE GRANT CITY CODE (ORDINANCE 02-03) BY REVOKING AND REPLACING §133.01 TITLED “DISCHARGE OF FIREARMS” TO ADD AN EXCEPTION TO THE SECTION; TO REPEAL ALL OTHER ORDINANCES AND RESOLUTIONS, OR PARTS THEREOF IN CONFLICT; TO PROVIDE THAT THE PROVISIONS OF THIS ORDINANCE SHALL BE MADE A PART OF THE CODE OF THE CITY OF GRANT; AND TO PROVIDE WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT.”

Action on Airport Taxi-way improvements – Discussion took place and the council wanted a few more financial questions answered.  A motion was made by Hansen to table the Airport Taxi-way Improvement to the next meeting and seconded by Pofahl.

Action on Resolution 09-12-01 Airport Hangar Fees – A motion was made by Pierce to approve Resolution 09-12-01 Airport Hangar Fees and seconded by Pick.

RESOLUTION APPROVING CHANGE IN AIRPORT HANGAR RATES
FOR THE CITY OF GRANT, NEBRASKA
The Mayor and Council of the City of Grant (hereinafter the City), in regular session assembled at the City Office Building in Grant, Nebraska on this 8th day of December, 2009, hereby resolve as follows:
WHEREAS, the City of Grant (CITY) owns and maintains the City Public Airport Hangar as part of the City; and
WHEREAS, the Airport Advisory Committee has recommended a change in hangar rates.
NOW, THEREFORE BE IT RESOLVED BY the governing body of the City of Grant, Nebraska, that effective December 8, 2009, hangar rates shall be as follows:

BE IT FURTHER RESOLVED, all fees paid and aircraft identification number and model of the aircraft to be stored are provided to the Treasurer of the City prior to housing the aircraft.
BE IT FURTHER RESOLVED, the City is no responsible for any aircraft stored at the City Public Airport Hangar.
BE IT FINNALLY RESOLVED, notice of rates and non-liability shall be posted.
PASSED, APPROVED AND ADOPTED THIS 8th DAY OF DECEMBER 2009.
