COUNCIL PROCEEDINGS
CITY OF GRANT, NEBRASKA
November 10, 2009
Mayor Michael Wyatt convened a meeting of the Council of the City of Grant, Nebraska in open and public session on November 10, 2009 at 7:00 p.m. Notice of this meeting was given in advance by publication in the Grant Tribune Sentinel, the City’s designated method for giving notice, November 5, 2009, and members of the City Council and a copy of their Acknowledgment of Receipt and the Agenda are attached to these minutes. Availability of the Agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting. All proceedings hereafter shown were recorded while said meeting was open to the attendance of the public.
Mayor Wyatt announced the posting of the Open Meetings Act and its location.
Roll call: Present Council members: Hansen, Pick, Pierce Pofahl, and Mayor Wyatt.
Others present: City Administrator Tyson McGreer, City Clerk/Treasurer Jessie Faber, City Attorney Phil Pierce, et al.
The motion was made by Pierce and seconded by Hansen to approve the agenda as presented.
Roll call vote: Yeas – all present. Nays – none. Motion carried.
A motion was made by Hansen to approve the minutes of the October 27, 2009 meeting and waive the reading and seconded by Pick.
Roll call vote: Yeas – all present. Nays – none. Motion carried.
COMMUNICATIONS: City Manager, Tyson McGreer, informed the council of an upcoming library meeting and Planning & Zoning Meeting. The city office will be closed for Veteran’s Day tomorrow. Tyson gave the council an updated on the sewer and water project and the water project has started and may take three to four weeks depending on the weather. Tyson informed the council that the audit fieldwork has been completed and Jessie plans to start the financial statements at the end of this week for the new fiscal year. Tyson also let the council know he would be out of town the rest of the week.
STANDING COMMITTEE REPORTS:
Council member, Hansen – gave an update on the library. Council member, Pofahl – gave an update on the planning and zoning committee. Council member, Pick – gave an update on the cemetery. Council member, Pierce – none.
WATER, ENFORCEMENT AND LOTTERY REPORTS - Acknowledged as received.
UNFINISHED BUSINESS:
Action on Resolution 09-11-01 Cemetery Rates – A motion was made by Pofahl to approve Resolution 09-11-01 and seconded by Pierce.
RESOLUTION NO. 09-11-01
RESOLUTION APPROVING CEMETERY FEES FOR THE CITY OF GRANT, NEBRASKA
The Mayor and Council of the City of Grant (hereinafter the City), in regular session assembled at the City Office Building in Grant, Nebraska on this 10th day of November, 2009 hereby resolve as follows:
WHEREAS, the City of Grant (CITY) owns and maintains the Fairview Cemetery as part of the City; and
WHEREAS, the City incurs expenses and costs in maintaining and operating the cemetery and desires to recover those costs.
NOW, THEREFORE BE IT RESOLVED BY the governing body of the City of Grant, Nebraska, that effective November 10, 2009, Cemetery Fees shall be as follows:
Resident
Lot Purchase Price……………………………………….. $150.00 + Filing Fee
Full Burial Grave Opening During Regular Hours………. $300.00
Charge for Grave Openings on Saturday & Sunday……... $400.00
Cremation Opening During Regular Hours……………… $75.00
Cremation Opening on Saturday & Sunday……………… $100.00
Stone Placement………………………………………….. $10.00
Non-Resident (Purchaser or Decedent)
A fee of $50.00 will be added to each of the above fees.
BE IT FURTHER RESOLVED that this Resolution shall take effect and be in full force from and after its passage, approval and publication as required by law.

NEW BUSINESS:
Action on Power Board Recommendation (Maintain current allocation of wind power) – A motion was made by Hansen to accept the Power Board recommendation to maintain the current allocation on wind power at this time and seconded by Pick.

7:15 Public Hearing on Proposed Annexation – The hearing was opened by Mayor Wyatt. City Manager, Tyson McGreer gave a power point presentation on the proposed annexation and answered questions that the public had on the annexation. Then the audience was allowed to voice their opinion to the council on the proposed annexation.
Mayor Wyatt closed the hearing at 8:55 p.m.
