COUNCIL PROCEEDINGS
CITY OF GRANT, NEBRASKA
October 27, 2009

            Mayor Michael Wyatt convened a meeting of the Council of the City of Grant, Nebraska in open and public session on October 27, 2009 at 7:00 p.m.  Notice of this meeting was given in advance by publication in the Grant Tribune Sentinel, the City’s designated method for giving notice, October 22, 2009, and members of the City Council and a copy of their Acknowledgment of Receipt and the Agenda are attached to these minutes.  Availability of the Agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting.  All proceedings hereafter shown were recorded while said meeting was open to the attendance of the public.
Mayor Wyatt announced the posting of the Open Meetings Act and its location.
Roll call:  Present Council members: Pick, Pierce, Pofahl and Mayor Wyatt. Absent: Hansen 
Others present:  City Administrator Tyson McGreer, City Clerk/Treasurer Jessie Faber, City Attorney Phil Pierce, et al.
The motion was made by Pick and seconded by Pofahl to approve the agenda as presented.
Roll call vote:  Yeas – all present. Nays – none.  Motion carried.
A motion was made by Pofahl to approve the minutes of the October 13, 2009 meeting and waive the reading seconded by Pierce.
Roll call vote:  Yeas – all present. Nays – none.  Motion carried.

COMMUNICATIONS:  City Manager, Tyson McGreer, informed the council of upcoming meetings for the Cemetery and the planning and zoning hearing.  Tyson asked if any of the council was planning to attend the hearing, so we can get a number and post the possible quorum notice.  Tyson gave an update on the water and sewer project.  The sewer is completed and they plan to start the water line this week or next week depending on the weather.  Mayor, Wyatt asked the council if they had been getting any response on the annexation. Do you have any questions that need to be researched and answered on the annexation?

STANDING COMMITTEE REPORTS: 
Council member, Hansen – none.  Council member, Pofahl – none.  Council member, Pick – none. Council member, Pierce – gave an update on the economic development committee.

NEW BUSINESS:
Action on Department of Roads Maintenance Agreement – A motion was made by Pick to accept the agreement with the Department of Roads and authorize the mayor to sign the agreement and seconded by Pierce.
Roll call vote:  Yeas – all present. Nays – none.  Motion carried.

Action on Resolution 09-10-04 Cemetery Monument Placement – A motion was made by Pick to accept Resolution 09-10-04 and seconded by Pofahl.
Roll call vote:  Yeas – Pofahl. Nays – Pick & Pierce.  Motion failed.

Action on Resolution 09-10-05 Cemetery Fees – Discussion took place and recommendations were made by Phil Pierce. No action taken.

Action on Resolution 09-10-06 Stop Sign on 2nd and Washington – A motion was made by Pofahl to approve Resolution 09-10-06 and seconded by Pick.
RESOLUTION NO 09-10-06
RESOLUTION FOR STOP SIGN ON 2ND STREET & WASHINGTON

The Mayor and Council of the City of Grant (hereinafter the City), in regular session assembled at the City Office Building in Grant, Nebraska on this 27th day of October, 2009, hereby resolve as follows:
WHEREAS, a request was received by the Mayor and Council of the City for a stop sign at the intersection on 2nd Street and Washington Avenue going North on the Southeast side within the City;
WHEREAS, the Council and Mayor have authority to regulate traffic within the City limits pursuant to Neb. Rev. Stat. §17-139 and Ordinance No. 71.03; and
WHEREAS, the Council and Mayor deem it in the best interest of the public to install said stop signs.
NOW THEREFORE, BE IT RESOLVED that the intersection at 2nd Street and Washington Avenue shall require that vehicular traffic traveling North on Washington Avenue stop before proceeding through said intersection and that said intersection shall be controlled with a stop sign placed at the Southeast corner of said intersection for Northbound traveling traffic on Washington Avenue.
BE IT FURTHER RESOLVED, that this Resolution shall take effect and be in full force upon the date and time that the said sign is placed at the intersection.

The motion was made by Pofahl and seconded by Pick to approve the Bills and Claims in the amount of $17,105.71.
Roll call vote:  Yeas – all present.  Nays – none.  Motion carried.

Pick & Pofahl reviewed the bills and claims prior to the meeting.

Mayor Wyatt adjourned this meeting of the Grant City Council at 7:57 P.M.
