COUNCIL PROCEEDINGS
CITY OF GRANT, NEBRASKA
November 11, 2008
Mayor Michael Wyatt convened a meeting of the Council of the City of Grant, Nebraska in open and public session on November 11, 2008 at 7:00 p.m. Notice of this meeting was given in advance by publication in the Grant Tribune Sentinel, the City’s designated method for giving notice, November 6, 2008, and members of the City Council and a copy of their Acknowledgment of Receipt and the Agenda are attached to these minutes. Availability of the Agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting. All proceedings hereafter shown were recorded while said meeting was open to the attendance of the public.
Mayor Wyatt announced the posting of the Open Meetings Act and its location.
Roll call: Present Council members: Brueggeman, Hansen, Pick, Pierce and Mayor Wyatt.
Others present: City Administrator Tyson McGreer, City Clerk/Treasurer Jessie Faber, City Attorney Phil Pierce, et al.
The motion was made by Brueggeman and seconded by Pierce to approve the agenda as presented.
Roll call vote: Yeas – all present. Nays – none. Motion carried.
A motion was made by Pierce to approve the minutes of the October 28, 2008 meeting and waive the reading and seconded by Pick.
Roll call vote: Yeas – Hansen, Pick, Pierce. Nays – none. Abstain – Brueggeman. Motion carried.
COMMUNICATIONS: City Manager, Tyson McGreer, informed the council of an upcoming Library and Park & Rec meeting, also I will be attending a City Managers meeting on Thursday. Tyson gave an update to the council on the hospital project that is about complete and that hopefully the holiday decorations on Central Avenue will begin going up at the end of the week, so they are up for the annual business open house. The council wondered if the tennis courts lights were on a timer because they may need adjusted. Also a question was brought up about the water surging on the east side of town and if it could be explained why it does that? This was the first time Tyson had heard anything about this and would look into why it does surge.

Hansen – tomorrow a Park & Rec meeting will be held. Council member, Brueggeman – none. Council member, Pick – gave an update on the cemetery committee. Council member, Pierce – none.
WATER, ENFORCEMENT AND LOTTERY REPORTS - Acknowledged as received.
FINANCIALS – Acknowledged as received.
UNFINISHED BUSINESS:
Action on Bid Opening for Economic Development Lease – All of the sealed bids were opened and examined. A motion was made by Pierce to accept Josh Day’s bid of $55.00 an acre for the economic development ground and was seconded by Brueggeman.

NEW BUSINESS:
Action on Ordinance 08-11-06 Issuance of sewer bonds – A motion was made by Pierce to waive the three readings of Ordinance 08-11-06 and read the first reading “An Ordinance Authorizing the Issuance of Sewer Bonds, of the City of Grant, Nebraska, in the Principal Amount of Two Hundred Twenty-Five Thousand Dollars ($225,000) to Construct Additions and Improvements to the Sanitary Sewer System of the City; Prescribing the Form of Said Bonds; Providing for the Levy and Collection of Taxes to Pay the Same; Providing for the Sale of the Bonds; Authorizing the Delivery of the Bonds to the Purchaser; Providing for the Disposition of the Bond Proceeds and Ordering the Ordinance Published in Pamphlet Form.” and seconded by Hansen.
Roll call vote: Yeas – all present. Nays – none. Motion carried.
A motion was made by Pierce to approve Ordinance 08-11-06 and seconded by Pick.

Action on Ordinance 08-11-01 Liquor License Occupation Tax – A motion was made by Brueggeman to waive the three readings of Ordinance 08-11-01 and read the first reading “An Ordinance of the City of Grant, Perkins County, Nebraska, Amending the Grant City Code (Ordinance 02-03) by Adding Section 111.05 to Create a Liquor License Occupation Tax Two Times the Amount of the License Fee; To Repeal All Other Ordinances and Resolutions, or Parts Thereof in Conflict; To Provide that the Provisions of This Ordinance Shall be Made a Part of the Code of the City of Grant; and to Provide the Date that this Ordinance Shall Take Effect.” and seconded by Pick.
Roll call vote: Yeas – all present. Nays – none. Motion carried.
A motion was made by Brueggeman to approve Ordinance 08-11-01 and seconded by Hansen.

Action on Ordinance 08-11-02 Water Fines – A motion was made by Pick to Send Ordinance 08-11-02 back to be rewritten and presented at the next meeting and seconded by Pierce.
Roll call vote: Yeas – all present. Nays – none. Motion carried.
Action on Ordinance 08-11-03 Nuisance Fine – A motion was made by Pierce to waive the three readings of Ordinance 08-11-03 and read the first reading “An Ordinance of the City of Grant, Perkins County, Nebraska, Amending the Grant City Code (Ordinance 02-03) by Amending Section 93.24 to allow the City to Assess Fines For Nuisances in Addition to Those Fines Ordered by the Court; To Repeal all Other Ordinances and Resolutions, or Parts Thereof in Conflict; To Provide That the Provisions of this Ordinance Shall be Made a Part of the Code of the City of Grant; and to Provide the Date that this Ordinance Shall Take Effect.”

Action on Ordinance 08-11-04 Parking Fine – A motion was made by Pick to waive the three readings of Ordinance 08-11-04 and read the first reading “An Ordinance of the City of Grant, Perkins County, Nebraska, Amending the Grant City Code (Ordinance 02-03) by Amending Section 72.61 to Increase Parking Violation Fines Assessed by the City; To Repeal all Other Ordinances and Resolutions, or Parts Thereof in Conflict; To Provide that the Provisions of this Ordinance Shall be Made a Part of the Code of the City of Grant; and to Provide the Date that this Ordinance Shall Take Effect.” and seconded by Brueggeman.
Roll call vote: Yeas – all present. Nays – none. Motion carried.
A motion was made by Pick to approve Ordinance 08-11-04 and seconded by Brueggeman.

Action on Wind Power option consideration with MEAN - A motion was made by Brueggeman to Participate with MEAN on the purchase of wind power at 2% and seconded by Pick.
